• 解釈学的臨床倫理学の方法論とその基礎としての近代ロマン主義的解釈学の研究, 服部 健司, 日本学術振興会, Japan Society for the Promotion of Science, 科学研究費助成事業 基盤研究(C), Grants-in-Aid for Scientific Research Grant-in-Aid for Scientific Research (C), 基盤研究(C), Grant-in-Aid for Scientific Research (C), 群馬大学, Gunma University, 2016年04月, 2021年03月, 研究代表者, 臨床倫理学の方法に関して1980年代半ば以降、数多の流派を生んできたオランダで解釈学的アプローチはその命脈を保ってきた。これは他国には見られない特異的な現象である。何故ほかならぬオランダの地において解釈学がなおわれわれの日常的な生の中に根づいているのか。この問いは本研究において主要な問いであった。昨年度はヴァン・ダルテルら編著『よいケアについての対話を続ける』の初版(2003)ならびに第二版(2014)において解釈学的アプローチの章を担当したリーケ・ヴァン・デア・スヘーアへのインタビューを重ね、彼女とともに臨床ケースを検討する機会を得たが、今年度はパウル・ヴァン・トンヘレンへのインタビューが実現した。ヴァン・トンヘレンによれば、1960～70年以降に拍車がかかった世俗化と脱柱状化を背景にして神学者が哲学・倫理学に転向し、また人々は聖職者の代わりに精神科医と倫理学者とに教えを求めるようになった。一部の倫理学者は「倫理のエンジニア」を自称して人々に問題の解法を提供するようになったが、これに対して元来カトリックを基礎に建学されたナイメーヘン(現ラドバウド)大学は、歴史的に神学と親和性の強い解釈学の拠点となり、即時問題解決型から距離をおく立ち位置を続け、大学理事に神学者がもはや一人もいなくなった今日においても哲学部において解釈学研究者を複数擁している。かくしてオランダと解釈学と臨床倫理学とをつなぐ線を引くことができた。が、しかし臨床倫理学の解釈学的アプローチには宗教色は前景にない。解釈学的倫理学と、臨床倫理学における解釈学的アプローチとの関係性についてさらに検 討が必要である。, 16K02107

Cooperative Studies on Policy Making of Advanced Medical Technologies in Europe (1) Some members participated the international research "Chimera and Hybrid in comparative European and International Research - scientific, ethical, philosophical and legal aspects" funded by European Commission, and contributed the making of guideline. (2) We have held continuous joint workshop with French researchers on the ethical and social issues in regenerative medicine, and published some articles on the international journals. 2. Research on the present state of US bioethics By the joint working for the translation of Encyclopedia of Bioethics by Macmillan Co. Ltd., we have got the information of policy making of advanced medical technologies in the US. 3. Joint research on genetic medicine We have conducted the joint research among Japanese, Austrian and German scholars on the problems of genetic testing and counseling, i.e. questionnaire survey, interviews with experts, intensive dialogue among persons concerned, joint workshop and writing paper. 4. Presentation of the Japanese current situation toward foreign researchers At the international conferences both abroad and domestic we have had opportunities of presentation regarding status quo of the research, policy making or task to be resolved, and exchanged opinions with foreign researchers., 17320006
• 予防医学における自律とパターナリズムに関する倫理学的研究, An Ethical Study on Autonomy and Paternalism in Preventive Medicine, 服部 健司, HATTORI Kenji, 日本学術振興会, Japan Society for the Promotion of Science, 科学研究費助成事業 基盤研究(C), Grants-in-Aid for Scientific Research Grant-in-Aid for Scientific Research (C), 基盤研究(C), Grant-in-Aid for Scientific Research (C), 群馬大学, Gunma University, 2004年, 2005年, 研究代表者, 歴史的にみてかつて今日ほど平均寿命が延び、健康を享受しえた時代はなかった。だがなおも、人々の健康への関心が煽りたてられ、自分の健康を保持増進することが各人の義務であることが公言され、ついには法の条文の中に盛りこまれるまでに至ったことは、逆説的である。こうした今日的状況は、ヘルシズムと称されている。すなわちヘルシズムとは、「個人の幸福を定義する上で、またその実現において、個人の健康を第一級の重点事項」とみなす立場(Crawford)、ないし、「健康それ自体を新しい道徳の中心に位置づけ、基本的な徳目の高みにまで引き上げようとする」立場(Minkler)である。つまり、健康状態はその人の道徳性、自己統御する自律的な意思の強さの鏡にほかならず、ここから、「誰もが自分の健康を最大化するように努めて生きるべきだ」という命法が導き出される。また不安を煽りつつ、健康のための方法論を提供する予防医学は擬似宗教化してきた。この擬似宗教にあって、病気は自虐の果ての罪深さの証左である。こうして日常生活の医療化と保健の道徳化が交差するところに疾病の自己責任論が浮上する。だが、この論が成立するためには、かなりの条件が満たされることが必要である。健康を増進する義務は本当にあるのだろうか。その義務はむしろ国家の側にある。だがしかし、それは、パターナリズム的に国民を健康に駆り立てるという仕方においてではない。そうではなくて、環境を保全すること、食や住居の安全を確保すること、医療へのアクセスをより容易にすること、医学や保健福祉の研究と教育を充実させることが先立つだろう。そして、これら自体、この国ではまだ道半ばのように思われる。, Recently the Health Promotion Law, which prescribes that all people have a duty to administrate their own health, has been enforced in Japan, whereby the life expectancy at birth for females is over 82 years. This paper is intended as a critical investigation of widespread discourses on the obligation to achieve good health for the people's own sake. In the beginning, we review the evolution of classical public health to the new public health movement. While classical public health addressed the improvement of the environment such as installing sewerage systems for infection prevention, the new public health movement since the mid 1970s has largely been concerned with our lifestyles. With some epidemiological surveys, both researchers and policy makers reached agreement on the tenet that reforming 'unhealthy' lifestyles is more effective and economical than curative health care practices. Thus, they insist that people have an obligation to promote their own health and prevent disease by self-discipline, and that medical intervention in people's lifestyle is justified. Here we outline the essential features of today's discourse on the duty to promote health as follows : healthism, a quasi-religious and moral characteristic of modern medicine, giving extraordinary meaning to diseases and illnesses by metaphors, the medicalization of our everyday life, and an excessive emphasis on personal responsibility for disease or illness as rhetoric to justify cutbacks in required health and social programs. As will be seen, we examine these claims of preventive medicine in detail. In conclusion, we cannot accept the idea of the obligation to promote health for people. On the contrary, it rather seems that the government is obliged to preserve the environment, to assure daily commodities' safety such as food, water, housing and so forth, and to improve health care services without paternalistic coercion., 16520004
